1. Advance Payment Is Non-Refundable

An advance payment is collected to initiate and reserve project-related resources, including human resources, technical resources, project planning, research, design, development, production, project management, and other activities required to execute the project.

Once an advance payment has been received and the project has been confirmed, the advance payment shall not ordinarily be refundable, including in circumstances such as:

• Change of mind by the client.
• Cancellation of the project by the client.
• Client deciding not to proceed with the project after confirmation.
• Change in the client’s business requirements after project confirmation.
• Delay or failure in providing required content, information, documents, credentials, approvals, or feedback.
• Failure of the client to respond or communicate within the required timeframe.
• Client deciding to engage another service provider after confirming the project.
• Delay caused by circumstances or dependencies attributable to the client.

The advance payment is therefore considered non-refundable once the project has been confirmed.

2. Project Confirmation

A project may be considered confirmed when the client:

• Approves or accepts a quotation or proposal;
• Gives written or electronic confirmation to proceed;
• Places an order;
• Makes an advance payment;
• Provides necessary project information or access for commencement of work; or
• Otherwise authorizes DUTTA INNOVATIONS to begin work on the project.

Once the project is confirmed, DUTTA INNOVATIONS may allocate human resources, technical resources, production capacity, and other resources specifically for the project.

4. Cancellation by the Client

Where work has already commenced, the client may also be required to settle any outstanding amount for work completed or undertaken up to the date of cancellation, depending on the agreed quotation, proposal, invoice, milestone structure, or project terms.

Cancellation of a project by the client does not automatically create any right to recover the advance payment.

5. Work Already Commenced

Once DUTTA INNOVATIONS has started work on a project, resources and professional time may have already been utilized.

Such work may include:

• Meetings
• Strategy development

• Coding and development

• Editing

• Other project-related activities

Payments associated with work that has already commenced are generally non-refundable.

6. Human Resources & Professional Efforts

DUTTA INNOVATIONS may allocate dedicated team members or human resources to a project after confirmation.

Such resources may include developers, designers, animators, video editors, digital marketing professionals, SEO specialists, project managers, consultants, or other personnel, depending on the requirements of the project.

The time, effort, expertise, and professional resources allocated to a project represent an actual cost to DUTTA INNOVATIONS.

Any refund that may be exceptionally approved will take into consideration the human resources, man-hours, professional efforts, and other resources already utilized for the project.

These costs may be deducted before calculating any eligible refund amount.

7. Scope Changes & Additional Requirements

The project scope, deliverables, revisions, features, timelines, and other requirements are generally defined in the applicable quotation, proposal, invoice, or project communication.

If the client requests changes or additional work beyond the agreed scope, additional charges may apply.

Requests for changes, additions, modifications, or additional features do not create any entitlement to a refund of amounts already paid.

8. Client Delays & Non-Cooperation

DUTTA INNOVATIONS shall not be responsible for delays caused by the client’s failure to provide required information, materials, approvals, access, feedback, or other dependencies.

Examples include:

• Delay in providing website content.
• Delay in providing images, videos, documents, or other assets.
• Delay in providing login credentials or access.
• Delay in providing business or technical information.
• Delay in approving designs or concepts.
• Delay in providing feedback.
• Unavailability of the client for required discussions or approvals.

Such delays shall not make the advance payment refundable.

9. Digital Marketing, SEO & Recurring Services

For digital marketing, SEO, social media management, advertising, website maintenance, hosting, consulting, or other recurring services, payments made for a particular service period are non-refundable once the applicable service period or work has commenced.

Digital marketing, SEO, advertising, and similar services may depend on third-party platforms, algorithms, market conditions, audience behaviour, competition, and other external factors.

Therefore, specific rankings, leads, traffic, sales, conversions, revenue, or other business results cannot be guaranteed unless expressly stated in a separate written agreement.

10. Third-Party Services & Expenses

Some projects may require the use or purchase of third-party products or services, including but not limited to:

• Domain names
• Web hosting
• Software
• Plugins
• Themes
• APIs
• Licenses
• Subscriptions
• Stock images or videos
• Fonts
• Advertising platforms
• Cloud services
• Payment gateway services
• Other third-party tools or resources

Where such expenses have already been incurred or committed on behalf of the client, they may be non-refundable and may be deducted from any refund that is exceptionally approved.

11. No Refund for Delivered or Substantially Completed Work

Once a deliverable, milestone, service, design, development component, creative asset, campaign activity, or other project component has been delivered or substantially completed, the corresponding payment will generally be considered earned and non-refundable.

The client’s decision not to use, publish, implement, launch, or continue using the delivered work does not automatically create an entitlement to a refund.

12. Exceptional Refund Consideration

Although advance payments are non-refundable, DUTTA INNOVATIONS may, at its sole discretion, consider a refund request in exceptional circumstances.

Any such refund will only be applicable if it is specifically approved by DUTTA INNOVATIONS in writing.

If a refund is exceptionally approved, the refund amount will be calculated after considering and deducting the costs, expenses, resources, professional efforts, and work already undertaken or utilized for the project.

These deductions may include, but are not limited to:

• Human resources allocated to the project.
• Man-hours and professional working hours.
• Developer, designer, animator, editor, marketer, SEO, consultant, or other professional costs.
• Project planning and management.
• Research and requirement analysis.
• Meetings and consultation.
• Design and creative work.
• Development and coding.
• Testing and implementation.
• Content preparation or processing.
• Animation and video production.
• Editing and post-production.
• Digital marketing or SEO activities already performed.
• Project coordination and communication.
• Third-party expenses.
• Software, licenses, subscriptions, hosting, domain, API, plugin, or other service charges.
• Payment gateway, transaction, banking, or processing charges.
• Administrative and operational expenses.
• Any other actual cost or expense incurred in connection with the project.

In simple terms, if DUTTA INNOVATIONS has already invested time, human resources, professional effort, technical resources, money, or other project-related resources, the corresponding cost may be deducted before determining any refundable amount.

Therefore, even if an exceptional refund is approved, the client may receive only the net amount remaining after applicable deductions.

13. Refund Calculation

Where an exceptional refund is approved, the calculation may generally be based on:

Amount Paid – Applicable Costs, Expenses, Resources, Efforts & Work Already Undertaken = Eligible Refund Amount

The final refundable amount, if any, will be determined by DUTTA INNOVATIONS based on the actual circumstances of the project and the resources and expenses already incurred or committed.

Approval of a refund in one particular case shall not create an obligation or precedent for future cases.

14. Payment Gateway, Bank & Transaction Charges

Where a refund is approved, any applicable payment gateway fees, transaction charges, banking charges, taxes, currency conversion charges, or other non-recoverable charges may be deducted from the refundable amount, where applicable.

15. Refund Processing

If a refund is approved by DUTTA INNOVATIONS, the applicable refund amount and processing details will be communicated to the client.

The refund, where applicable, will be processed through an appropriate payment method after completion of the necessary verification and calculation of applicable deductions.

The processing time may depend on the payment method, banking institution, payment gateway, or other financial service provider involved.

16. No Automatic Right to Refund

A request for cancellation, dissatisfaction, change of business plans, change of mind, decision to discontinue the project, or engagement of another service provider does not automatically create a right to a refund.

17. Communication & Project Records
